In the event of a conflict between these Terms and a signed engagement agreement, the engagement agreement controls.

You must be at least 18 years old and able to form a legally binding contract to use our services. By using our website or services, you represent and warrant that you meet these requirements.

Unless otherwise agreed in writing, invoices are due upon receipt. We reserve the right to suspend or terminate services for non-payment. Consultations are offered subject to availability.
6. Intellectual property
All content on this website — including text, graphics, logos, and design — is the property of Merc Growth or its licensors and is protected by applicable intellectual property laws. Deliverables produced during an engagement are governed by the terms of the applicable engagement agreement. You may not use our trademarks or content without our prior written consent.

Merc Growth does not control and is not responsible for the acts, omissions, or work product of third parties. Any contract you enter into with a third party is between you and that party.

12. SMS / text messaging program
If you provide your mobile number and opt in, Merc Growth may send you SMS text messages. Use cases include appointment scheduling and reminders, replies to your inquiries, and project and service updates — and, only if you separately consent, occasional promotional messages. You must be at least 18 years old to enroll in our SMS program.
